By accessing and using ThumbnailMaker.ai ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

ThumbnailMaker.ai is a web-based tool that allows users to generate YouTube thumbnails using AI image generation. The Service uses AI models (including Google Gemini via OpenRouter and Google's API) to generate thumbnails based on your descriptions, uploaded face photos, and style references.

3. Account Requirements

An account is required to use ThumbnailMaker.ai. By creating an account, you agree to:

  • Provide accurate and complete information during registration.
  • Maintain the security of your account credentials.
  • Accept responsibility for all activities that occur under your account.
  • Notify us immediately of any unauthorized access to your account.

4. User Responsibilities

  • You are solely responsible for the content you generate using the Service.
  • You must not use the Service to generate illegal, harmful, or rights-infringing content.
  • You must not attempt to reverse engineer, modify, or interfere with the Service's operation.
  • You must have the right to use any face photos or images you upload to the Service.

5. Content Ownership & Data Storage

Images generated through ThumbnailMaker.ai are subject to the terms and licensing of the underlying AI models. Generally, you retain rights to use the generated images for your YouTube content, but please review Google's Gemini API Terms for specific details.

Uploaded Images: Any face photos you upload are stored on our servers to enable thumbnail generation with your likeness. Style reference images are processed to generate thumbnails but are not permanently stored. You retain ownership of all images you upload.

Generated Thumbnails: All thumbnails you generate are stored on our servers and associated with your account until you choose to delete them or delete your account.

6. Prohibited Uses

You agree not to use the Service to:

  • Generate content that is illegal, defamatory, or infringes on others' rights
  • Create deepfakes or misleading content without proper disclosure
  • Generate content depicting minors inappropriately
  • Impersonate others without authorization or upload face photos of others without their consent
  • Create content that violates YouTube's community guidelines
  • Attempt to bypass AI safety measures or content filters

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee that the Service will be error-free, uninterrupted, or meet your specific requirements. AI-generated content may contain inaccuracies or artifacts.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO COSTS INCURRED FROM API USAGE, LOST PROFITS, OR DATA LOSS.

9. Subscription, Credits & Billing

ThumbnailMaker.ai operates on a credit-based system with the following plans:

  • Starter: Monthly credits for 1K and 2K resolution thumbnails.
  • Pro: Monthly credits for 1K, 2K, and 4K resolution thumbnails.
  • Max: Higher monthly credits for 1K, 2K, and 4K resolution thumbnails.

Standard thumbnails (1K/2K) cost 1 credit each. High-resolution 4K thumbnails cost 2 credits each. Paid subscriptions are billed monthly and can be cancelled at any time. Payment processing is handled by our third-party payment provider. Refunds are handled on a case-by-case basis—please contact support for assistance.

10. Third-Party Services

The Service relies on third-party providers to function. By using the Service, you acknowledge that your data (including prompts, uploaded images, and generated content) may be processed by:

  • Google Gemini: For AI image generation
  • OpenRouter: As an API intermediary for AI services
  • Clerk: For authentication and account management
  • Convex: For data storage and backend services

Please review the privacy policies and terms of service of these providers as applicable.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. Material changes will be indicated by updating the "Last updated" date.

12. Termination

We reserve the right to terminate or restrict access to the Service at any time, for any reason, without notice. Upon termination of your account:

  • Your account data, uploaded images, and generated thumbnails stored by us will be deleted.
  • Data that has been shared with third-party services (Google, OpenRouter, analytics providers) is subject to their respective data retention policies.
  • Any unused credits will be forfeited.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Service operators are based, without regard to conflict of law principles.
